These Terms and Conditions govern your access to and use of the TimeBinder platform, including the TimeBinder website, app, and any related services (collectively, “TimeBinder”). By accessing or using TimeBinder, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use TimeBinder.
1. About TimeBinder
TimeBinder (ABN 95783170741) is a digital timestamping service that allows users to generate cryptographic hashes of files locally in their browser and anchor those hashes to the Bitcoin blockchain. TimeBinder does not upload, store or view your files. Only file-hashes and reference data (if provided) are processed by TimeBinder.
The purpose of TimeBinder is to provide evidence of the date and time at which a file existed. TimeBinder does not verify or guarantee authorship, ownership, accuracy, truthfulness or legal admissibility of any content.
2. Definitions
“TimeBind” means the process of hashing up to 10 user-selected files, generating a Merkle tree, and anchoring the resulting root hash to the blockchain.
“ASAP TimeBind” means a TimeBind where the root hash is submitted directly to the blockchain as its own individual transaction.
“Pooled TimeBind” means a TimeBind where multiple users’ hashes are aggregated and only the top-level combined hash is submitted to a blockchain transaction.
“Proof of Time Certificate” or “Certificate” mean the document generated after processing that contains the TimeBind details and verification information.
3. Service Description
TimeBinder provides:
• local SHA-256 hashing of user files in-browser
• Merkle tree generation
• blockchain submission of root hashes
• user-specific Certificates and identifiers
• verification tools for checking correspondence between a file and a TimeBind
TimeBinder does not:
• store, access, retain or upload your original files
• guarantee the authenticity, ownership or authorship of any file
• provide legal advice, certification, or confirm evidentiary admissibility
• provide an API or developer integration
• allow users to search the database by uploading a file
4. User Responsibilities
By using TimeBinder, you agree that you are solely responsible for:
- maintaining secure copies of your original files
- storing your Certificate and TimeBind information
- using accurate reference or description text
- verifying that your files hash correctly before relying on a TimeBind
- ensuring your use of the service complies with applicable laws
- securing your account login methods
- any sharing of Certificates, QR codes or verification links
If you lose your original file or Certificate, TimeBinder cannot recreate or retrieve them.
5. ASAP vs Pooled TimeBinds
5.1 ASAP TimeBinds
ASAP TimeBinds are submitted as individual blockchain transactions. Your Certificate contains all data required for independent verification without any reliance on TimeBinder’s ongoing operation.
5.2 Pooled TimeBinds
Pooled TimeBinds are combined with other users’ hashes into a single Merkle tree and only the combined top-level hash is written to the blockchain.
Verification of Pooled TimeBinds requires TimeBinder to maintain the Merkle inclusion proof. If TimeBinder ceases operations, Pooled TimeBinds may not be independently verifiable on the blockchain.
By choosing a Pooled TimeBind, you acknowledge and accept this technical limitation.
6. Verification
Verification occurs by hashing your selected file locally in your browser and comparing it with the Certificate or TimeBind record.
TimeBinder does not review, store or access your file at any stage.
You acknowledge that:
• verification depends on your possession of the original file
• modifications, compression or metadata changes may alter the hash
• TimeBinder is not responsible for failed verification resulting from file corruption, editing or loss
7. No Guarantee of Legal Admissibility
TimeBinder provides timestamping and cryptographic proof of existence only.
TimeBinder does not guarantee that any Certificate, hash, or blockchain reference will be accepted as evidence by any court, authority or institution.
Legal admissibility varies by jurisdiction and by the nature of the matter. You should seek independent legal advice before relying on a TimeBind in a legal context.
8. Payment Terms
Payments may be made via credit card through Stripe, Token purchases, or other methods introduced in future.
All fees are displayed in USD unless stated otherwise.
Payments are non-refundable except where required by law.
9. Service Availability and SLA
TimeBinder is provided on a best-effort basis.
TimeBinder does not guarantee uninterrupted access, continuous uptime or specific processing times. Blockchain congestion, node issues, maintenance, and network conditions may cause delays.
If there is an outage:
• queued TimeBinds may be delayed
• verification services may be temporarily unavailable
• Pooled TimeBinds may be postponed to the next available batch
TimeBinder is not liable for any loss arising from delays or unavailability.
10. Data Handling, Privacy and Security
TimeBinder is designed to minimise data exposure. Specifically:
• Your files never leave your device.
• TimeBinder processes only hashes and optional reference/description text.
• All data in transit is encrypted.
• Hashes, metadata and Certificates are stored in encrypted databases.
• TimeBinder does not store any content of your files.
• You may request deletion of account-related data at any time (subject to legal obligations).
TimeBinder retains TimeBind records as long as necessary to operate verification services, unless prohibited by law or unless the user requests deletion of their account.
11. Data Portability and Export
TimeBinder will make available:
• your Certificates
• your TimeBind identifiers
• your verification information
• your transaction history
For ASAP TimeBinds, the Certificate contains all data needed for independent verification.
For Pooled TimeBinds, continued verification requires TimeBinder’s infrastructure. TimeBinder does not guarantee that Pooled verification will remain available indefinitely.
12. Acceptable Use
You must not use TimeBinder for:
• unlawful, fraudulent or harmful activities
• storing, distributing or linking to illegal content
• attempting to disrupt or reverse-engineer the service
• interfering with blockchain operations
• providing false, misleading or deceptive information
TimeBinder may suspend or terminate accounts involved in prohibited conduct.
13. Warranties and Disclaimers
TimeBinder is provided “as is” and “as available”.
To the extent permitted by law, TimeBinder disclaims all warranties, including:
• merchantability
• fitness for a particular purpose
• uninterrupted or error-free service
• suitability for legal purposes
• accuracy of blockchain confirmation times
TimeBinder does not warrant that Certificates, timestamps or hashes will achieve any legal or evidentiary effect.
Nothing in this clause limits any mandatory rights under the Australian Consumer Law (for eligible users).
14. Limitation of Liability
To the maximum extent permitted by law:
• TimeBinder is not liable for any indirect, consequential, incidental, punitive or special loss.
• TimeBinder is not liable for loss of revenue, data, profits, business or opportunity.
• TimeBinder’s total liability for all claims in aggregate is limited to the total fees paid by you to TimeBinder in the preceding 12 months, or USD $10, whichever is greater.
This limitation applies regardless of the cause of action, including negligence.
15. Indemnity
You agree to indemnify and hold TimeBinder harmless against all claims, damages, liabilities, costs and expenses arising from:
• your misuse of TimeBinder
• your breach of these Terms
• any third-party claims relating to content you hash, reference or verify
• any reliance you or others place on a TimeBind or Certificate
16. Termination
You may stop using TimeBinder at any time.
TimeBinder may suspend or terminate your account if:
• you breach these Terms
• you misuse the service
• your use presents security, legal or operational risk
Upon termination:
• previously issued ASAP Certificates remain verifiable
• previously issued Pooled Certificates remain verifiable only while TimeBinder maintains the Merkle data
• TimeBinder may delete stored metadata after the required retention period
17. Changes to the Service or Terms
TimeBinder may modify these Terms or its services at any time. Updates will be published on the website. Continued use of TimeBinder after changes take effect constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of Queensland, Australia.
You submit to the exclusive jurisdiction of the courts of Queensland.
